MUTUAL EVALUATION FOR THE KINGDOM OF LESOTHO

ESAAMLG COUNCIL OF MINISTERS ADOPTS THE MUTUAL EVALUATION REPORT FOR THE KINGDOM OF LESOTHO

The ESAAMLG Council of Ministers approved and adopted the mutual evaluation report for the Kingdom of Lesotho in September 2011. The report was prepared by ESAAMLG experts and was fully discussed and adopted by the ESAAMLG Task Force of Senior Officials in the same month of September 2011, before its approval by the Council of Ministers.

The report summarises the AML/CFT framework in the Kingdom of Lesotho and the commitment of the Government of the Kingdom of Lesotho to develop an AML/CFT regime which is in compliance with the FATF standards.

The criminal justice system of the Kingdom of Lesotho combines both common law and statutory offences. The MLPCA of 1 April 2009 is the main law which provides the AML/CFT legal framework in the Kingdom of Lesotho. The MLPCA criminalises the offences of ML and TF, provides for the establishment of the FIU and its functions, sets out preventive measures applicable to accountable institutions and their AML/CFT obligations. The Kingdom of Lesotho has not yet issued regulations to assist with the implementation of the MLPCA.

The report also discusses the areas of deficiencies identified in the Kingdom of Lesotho's AML/CFT framework. The report further makes detailed recommendations on how the Kingdom of Lesotho can address these areas in order to comprehensively strengthen its AML/CFT regime to meet international standards. The recommendations provide short and medium term measures which the Kingdom of Lesotho can take to address the deficiencies.
